Terms of Service

These Terms of Service ("Terms") govern your use of Olympia's website and services, including our VPS/dedicated server hosting, application hosting, and migration services. By purchasing or using our services, you agree to these Terms.
Who you are contracting with. Olympia is a service of Circus Corporation, a corporation incorporated in the State of Delaware, United States. "Olympia", "we", "us" and "our" in these Terms mean Circus Corporation. Olympia is a trading name and product of that company, not a separate legal entity, and your contract for any Olympia service is with Circus Corporation.
Currency. Every price shown on this site, in the configurator, at checkout and on your invoices is in US dollars (USD). We do not price, bill or refund in any other currency. If your card is denominated in another currency, your bank or card network sets the conversion rate and may add its own fee. That fee is theirs, not ours, and we cannot refund it.
1. Service description
Olympia provides virtual private server (VPS) hosting across five tiers (Ionia, Sparta, Colossus, Titan, Atlas), dedicated server hosting, self-hosted open-source application catalogs, and assisted migration services that move your existing infrastructure or SaaS stack onto Olympia's hosting. Specifications and pricing for each tier are listed on our pricing page.
2. Billing and automatic renewal
VPS and dedicated server plans are billed monthly in advance in US dollars via Stripe, at the flat rate shown for your tier at the time of purchase. The only usage-based component is bandwidth overage: each tier includes 20 TB of outbound (egress) transfer per month (inbound traffic is not counted), and egress above that allowance is billed at $1 per TB. Overage, if any, appears on your next invoice.
Your subscription renews automatically. In plain terms:
- When you check out, you are starting a recurring monthly subscription, not making a one-time purchase.
- We charge the card you used at checkout once a month, automatically, on the monthly anniversary of your first payment, and we keep charging it until you cancel.
- The amount charged each month is the USD price shown for your configuration at checkout, plus any bandwidth overage from the previous month. Your checkout page and your Stripe receipt both show that amount before you pay.
- There is no minimum term, no lock-in and no cancellation fee. You can cancel at any time, and canceling stops the next charge — see section 4 for exactly how.
Migration Assessment, SaaS Cost Reduction Consulting and Custom Software Solutions are offered free of charge and do not require payment or a card on file. We will notify you in advance of any price change to your existing subscription, and you can cancel before it takes effect; continued use after a price change takes effect constitutes acceptance of the new price.
3. Acceptable use
You agree not to use our services to:
- Host or distribute illegal content, or content that infringes on the intellectual property rights of others;
- Send unsolicited bulk email (spam) or engage in phishing;
- Launch or participate in attacks on other systems (e.g. DDoS, port scanning of third parties, malware distribution);
- Violate applicable law, or attempt to circumvent the security or resource limits of our infrastructure or that of others.
We reserve the right to suspend or terminate service for violations of this section, with notice where practicable given the severity of the issue.
4. Canceling your subscription
How to cancel. Ask us, through our contact page, and say you want to cancel. Include the email address you used at checkout so we can find your subscription. You do not have to give a reason, sit through a retention offer, or call anyone. A person handles the request and cancels the subscription in Stripe.
We do not have a self-service cancel button yet. There is no customer dashboard and no billing portal today, so the request above is the cancellation mechanism, and it is the one we support. We would rather tell you that than point you at a page that does not exist.
What happens next. We acknowledge cancellation requests within 48 hours and confirm in writing once the subscription is canceled. Your service stays live until the end of the month you have already paid for, and then stops. If your request reaches us before your next renewal date, you will not be charged again. If a renewal charge goes through after you asked to cancel because we were slow, we refund that charge in full — see our Refund Policy.
Suspension or termination by us. We may suspend or terminate your service for non-payment, violation of these Terms, or if required by law, and will make reasonable efforts to notify you before doing so except where immediate action is necessary to protect our infrastructure or other customers.
5. Data and portability
You retain ownership of your data and any software you run on your server. You have root access on every VPS/dedicated tier and can export your data at any time; we do not lock your workloads into proprietary tooling. See our portability statement for more detail.
6. Disclaimer and limitation of liability
Our services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, Circus Corporation is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data, arising from your use of our services. Our total liability for any claim relating to our services is limited to the amount you paid us in the 3 months preceding the claim.
To be explicit about what we do not offer, so nobody has to guess: there is no uptime SLA and there are no service credits. We do not publish an uptime percentage, because we do not yet run automated uptime monitoring and would have to invent the number — see our status page. We hold no SOC 2 attestation, no ISO 27001 certification and no completed third-party penetration test — see our security page. Two delivery promises we do make: servers are provisioned within 24 hours of your order, and support requests get a reply within 48 hours.
7. Governing law
These Terms, and any dispute arising out of them or out of our services, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Circus Corporation agree that the state and federal courts located in Delaware have exclusive jurisdiction over any such dispute, and each of us consents to personal jurisdiction and venue there.
If any part of these Terms is found unenforceable, the rest stays in force. Nothing here takes away a right you have under the law of your own state or country that cannot be waived by agreement.
8. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above when we do, and will make reasonable efforts to notify active subscribers of material changes.
9. Third-party marks and attributions
Product names, logos and brands shown on this site belong to their respective owners. We use them only to identify the software we host, migrate or compare against. Olympia is an independent project and is not affiliated with, endorsed by, or a partner of any of them. Olympia hosts and customizes third-party open-source software; it does not develop it.
